In Indiana, what are the laws regarding pedestrian right of way in parking lots?
Last week I was struck by a vehicle while walking to my own in a mall parking lot. Besides some minor bruising and swelling, and a lot of soreness, I am OK. Her insurance company agent made the statement that "both of you were at fault". I didn't like that, now I want to determine who was at fault. My understanding is that pedestrians have the right of way in ALL parking lots, and it is the motorists responsibility to yeild for them at ALL times. But if anyone has specific laws or regulations they can site, I would appreciate it. Many thanks. Her insurance company is State Auto and is offering to pay for all medical expenses and an additional $100 for my suffering. I already told him that $100 was an insult.

- Pedestrians always have the right of way and the operator of any vehicle has to keep an eye on this type of situation and at the same time be in complete control of the vehicle.
- Pedestrains always have the right away, no matter who is at fault. Since this happened on private property you could have more problems with them getting to pay anything.
- HELL YEAH! ALL PEDESTRIANS HAVE THE RIGHT OF WAY, no matter what (unless you're on a divided expressway and obviously suicidal). Leave it in the hands of an attorney. Don't even use your insurance company since your vehicle was not involved... Don't talk to them call any Lawyer, they'd be happy to assist your case! BTW What is her insurance company?
